TERMS OF SERVICE
GENERAL INFORMATION
Welcome to Meals4hope.
The terms "we," "us," "our," and "Meals4hope" refer to Meals4hope, an entity registered in Spain, whose legal details are provided in the store's legal information. Meals4hope manages this store and this website, including its content, functionalities, tools, products, and related services, within the framework of the Art4Venezuela project.
The store uses Shopify as the technology platform to provide certain services related to the store and e-commerce operations.
These Terms of Service govern access to and use of our website, store, and services. By accessing, browsing, or using our Services, or by making a purchase, you accept these Terms. If you do not agree with these Terms, you should not use our Services.
PURPOSE OF THE STORE AND USE OF PROCEEDS
The purpose of the store is to contribute to Meals4hope's Art4Venezuela project. Proceeds obtained from sales will be allocated to the project after deducting costs directly related to production, fulfillment, payment processing, taxes, and other applicable costs. Nothing in these Terms is intended to exclude, limit, or diminish the rights that consumers may have under applicable mandatory laws.
SECTION 1 — ACCESS AND ACCOUNT
By accepting these Terms, you represent that you have the minimum legal age required to enter into binding contracts in your place of residence. If you allow a minor to use our Services, you will be responsible for ensuring that such use is carried out in accordance with applicable law.
To make purchases, we may request information such as name, email, billing information, payment information, and shipping address. You represent that all information provided is true, accurate, current, and complete. We reserve the right to refuse service, cancel accounts, or cancel orders when there is a legitimate reason to do so, always in accordance with applicable law.
SECTION 2 — OUR PRODUCTS
Art4Venezuela exclusively offers fine art prints and personalized postcards, made to order for each order.
Fine art prints and postcards are produced specifically as a result of each order. Images, colors, and appearance may vary slightly depending on the device, screen, and viewing conditions. The characteristics, dimensions, materials, and available options will be indicated on the corresponding product page.
Due to their personalized nature and the fact that they are manufactured specifically as a result of each order, fine art prints and personalized postcards cannot be returned due to a change of mind, regret, error in product selection, or any other reason unrelated to a defect, damage, or lack of conformity.
This condition does not limit the consumer's legal rights when the product is defective, has suffered damage during transport, is incorrect, or does not correspond to the order placed.
SECTION 3 — ORDERS AND CONTRACTING
When you place an order, you are making an offer to purchase the selected fine art prints or personalized postcards.
Receipt of an order does not necessarily mean that it has been accepted. The contract will be considered concluded when we confirm acceptance of the order, unless applicable law establishes otherwise.
Once the order is confirmed, the print or postcard goes into on-demand production. Due to its personalized nature, cancellations due to a change of mind or regret will not be accepted once the production process has begun, without prejudice to the legal rights applicable to defective, damaged,
incorrect, or non-conforming products.
We reserve the right to refuse or cancel an order for legitimate reasons, including manifest
errors in price or availability, reasonable suspicion of fraud, shipping restrictions, or the inability to produce or deliver the requested product.
If we cancel an order for a reason attributable to Meals4hope after having received payment, we will refund the corresponding amounts in accordance with applicable law. We recommend that you carefully review your order and the selected customization before confirming it.
SECTION 4 — PRICES, TAXES, AND PAYMENTS
Prices shown in our store may change at any time. The applicable price will be the one indicated at the time of purchase, except in the case of a manifest pricing error. Prices will include taxes that must legally be included in the advertised price, where applicable.
Depending on the destination country, taxes, customs duties, import fees, or other charges may apply. Discounts and promotions may be subject to specific conditions. Payments are processed through authorized payment service providers. Meals4hope does not necessarily store complete payment card data.
SECTION 5 — SHIPPING, DELIVERY, AND RISK
We offer shipping options depending on the destination country or region and the options available at the time of the order. The delivery times indicated are estimates, unless expressly stated to constitute a contractual deadline. International shipments may be affected by customs procedures, import restrictions, weather conditions, strikes, logistical problems, carrier delays, or other circumstances beyond our control.
When Meals4hope is responsible for arranging transport, the risk of loss or damage will remain with Meals4hope until the consumer, or a third party designated by them other than the carrier, takes physical possession of the products, unless applicable law establishes otherwise. Nothing in this section limits the rights that consumers may have.
SECTION 6 — INTELLECTUAL PROPERTY
The Services, including names, logos, trademarks, texts, photographs, images, graphics, videos, audio, designs, editorial content, and content related to the prints and postcards, belong to Meals4hope, its licensors, or third-party rights holders.
The Services are provided for personal and non-commercial use, unless expressly authorized. Except with prior written authorization or where permitted by applicable law, you may not reproduce, distribute, modify, create derivative works from, publish, transmit, store, or commercially exploit content from the Services.
SECTION 7 — THIRD-PARTY TOOLS AND SERVICES
We may provide access to tools or services offered by third parties, subject to their own terms and policies. To the extent permitted by applicable law, Meals4hope will not be responsible for services provided directly by third parties. This provision does not limit liabilities that legally cannot
be excluded.
SECTION 8 — THIRD-PARTY LINKS AND SERVICES
Our Services may contain links or functionalities provided by third parties. We are not responsible for the content, availability, accuracy, or practices of third-party websites, except where applicable law establishes otherwise.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Meals4hope uses Shopify as the technology platform to operate the store and provide certain services related to e-commerce.
Purchases made through our store are entered into between you and Meals4hope, unless expressly stated otherwise.
Shopify is not the seller of the fine art prints or personalized postcards offered by Meals4hope. Nothing in this section limits the rights that consumers may have against Meals4hope.
SECTION 10 — PRIVACY
The processing of personal data collected through our Services is governed by the privacy information made available to the user in the store.
Shopify and other technology or service providers may process certain personal data necessary to provide the Services.
Where applicable, the processing of personal data will be carried out in accordance with the GDPR and applicable Spanish legislation.
SECTION 11 — COMMENTS AND USER-SUBMITTED CONTENT
If you submit comments, opinions, photographs, reviews, suggestions, ideas, or other content, you grant us, to the extent permitted by applicable law, a non-exclusive, worldwide, royalty-free, and sublicensable license to use them for the purpose of operating, promoting, improving, and providing our Services.
You represent that you have the necessary rights to provide such content and that its publication will not infringe third-party rights.
You must not submit illegal, defamatory, abusive, threatening, discriminatory, obscene, fraudulent content, or content that infringes third-party rights.
SECTION 12 — ERRORS AND INACCURACIES
Occasionally, a typographical error, inaccuracy, or omission related to prints, postcards, prices, promotions, availability, shipping costs, or similar information may occur. We reserve the right to correct such errors and update information. If an order has been placed based on a manifest error, we may cancel the order and refund the amounts paid, without prejudice to the rights legally recognized to the consumer.
SECTION 13 — PROHIBITED USES
You may use the Services only for lawful purposes. You may not use the Services for illegal, fraudulent, or malicious purposes; to infringe laws or rights of
third parties; to transmit false or misleading information; to introduce viruses or malicious code; to engage in spam, phishing, or other fraudulent activities; to obtain unauthorized access; to collect personal information from third parties without authorization; or to circumvent security measures.
SECTION 14 — AGENTS AND AUTOMATED SYSTEMS
Automated systems must not be used for fraudulent activities, unauthorized mass data extraction, overloading of the Services, circumvention of access restrictions, or any illegal activity. We may limit or block automated access when necessary to protect our systems,
our users, or our rights.
SECTION 15 — TERMINATION
We may suspend or cancel your access to certain Services when there is a legitimate reason, including breach of these Terms, fraud, misuse of the Services, or legal requirements. Termination will not affect rights or obligations that arose before termination.
SECTION 16 — WARRANTIES AND EXCLUSIONS
We strive to ensure that the information provided through the Services is accurate and up to date. To the fullest extent permitted by applicable law, the Services may be provided "as is" and "as available."
Nothing in these Terms excludes or limits statutory warranties, conformity rights, or
other obligations that cannot be excluded or limited under applicable law. Fine art prints and personalized postcards sold to consumers will be subject to the applicable legal warranties.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Meals4hope will not be liable for indirect, incidental, special, or consequential damages that are not reasonably foreseeable. Nothing excludes or limits liabilities that legally cannot be excluded or limited, nor the legal rights of consumers.
SECTION 18 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to hold Meals4hope harmless from third-party claims arising directly from a breach of these Terms, from unlawful or fraudulent use of the Services, or from the infringement of third-party rights caused by content you have provided.
This provision will not apply to the extent that it is incompatible with the legal rights of a consumer.
SECTION 19 — SEVERABILITY
If any provision is declared illegal, invalid, or unenforceable, it will apply to the fullest extent permitted and will be considered severed to the extent necessary. The invalidity of one provision will not affect the validity of the remaining provisions.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
The fact that we do not immediately exercise a right provided for in these Terms does not constitute a waiver of that right. These Terms constitute the agreement applicable to the use of our Services, together with the information and policies expressly incorporated into the store. The provisions shall not be interpreted in a way that reduces consumers' non-waivable rights.
SECTION 21 — ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits such transfer. Meals4hope may transfer or assign its rights and obligations when there is a legitimate reason and in accordance with applicable law.
SECTION 22 — GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with Spanish law, unless applicable mandatory legislation provides otherwise. When you act as a consumer, this choice of law shall not have the effect of depriving you of the protection afforded to you by the mandatory consumer protection provisions applicable in your country of residence. Consumers residing in the European Union will retain the rights afforded to them under applicable consumer protection legislation. For consumers, any dispute will be subject to the courts that are legally competent under applicable law.

Titles and headings are included for ease of reading only and do not affect the interpretation of the provisions.
SECTION 24 — MODIFICATIONS TO THE TERMS
You can consult the most recent version of these Terms at any time on this page. We may update or modify these Terms when necessary to reflect legal, operational, or Service changes. When a modification is material and applicable law requires notice, we will provide the corresponding
notice. Changes will not retroactively affect consumer rights where applicable law prevents this.
SECTION 25 — RETURNS AND PERSONALIZED PRODUCTS
This section fully governs returns and claims related to the personalized fine art prints and postcards sold through Art4Venezuela.
25.1 — Returns due to change of mind are not accepted
All fine art prints and personalized postcards offered on Art4Venezuela are manufactured on demand and personalized for each order. For this reason, returns or cancellations are not accepted due to a change of mind, regret, error in product selection, or any other reason unrelated to a defect, damage, or lack of conformity.
This condition applies to these products to the extent permitted by applicable law and does not limit the consumer's legal rights regarding defective, damaged, incorrect, or non-conforming products.
25.2 — Defective, damaged, or incorrect products
If a print or postcard arrives defective, damaged during transport, incorrect, or does not correspond to the order placed, the consumer must contact Meals4hope by email at art4venezuela@meals4hope.org
To facilitate the handling of the issue, we may request the order number, a description of the problem, and photographs of the product and packaging. This request for information does not limit the consumer's legal rights.
Where there is a lack of conformity, Meals4hope will handle the claim in accordance with applicable legislation. Depending on the circumstances, the solution may include replacement, repair, price reduction, or resolution of the contract, as well as the legally applicable refund.
When the problem is attributable to a production or fulfillment error, Meals4hope will work with the relevant provider to implement the applicable solution without passing on to the consumer costs that legally must be borne by Meals4hope.
25.3 — Products damaged during transport
If the print or postcard arrives visibly damaged, we recommend reporting it by email as soon as reasonably possible, providing photographs of the packaging and the product. This recommendation is intended to facilitate the handling of the issue and does not limit the deadlines or legal rights of the consumer.
25.4 — Refunds
When, in accordance with applicable legislation, a refund is due for a defective, damaged, incorrect, or non-conforming print or postcard, Meals4hope will process the refund or apply the corresponding legal remedy using the same payment method used in the original transaction, unless another method is expressly agreed and provided that this does not entail any cost to the consumer.
25.5 — Legal warranty of conformity
Consumers have legal rights regarding the conformity of the prints and postcards purchased. When a print or postcard shows a lack of conformity, the rights to repair, replacement, price reduction, or resolution of the contract will apply as applicable under applicable legislation.
In Spain, consumer goods are subject to national rules on the legal warranty of conformity. These rights are independent of any additional commercial warranty that Meals4hope may offer.
SECTION 26 — SPECIFIC PROVISIONS FOR SPAIN AND THE EUROPEAN
UNION
Where Spanish or European Union consumer protection legislation is applicable, the corresponding mandatory provisions will be respected.
Nothing in these Terms is intended to exclude or limit consumers' non-waivable rights. The reference to personalized, made-to-order products will apply only to the extent to which the corresponding legal exception is applicable to the prints or postcards and the specific contract.
SECTION 27 — TAXES, CUSTOMS, AND INTERNATIONAL ORDERS
Meals4hope may accept orders from different countries. The availability of prints and postcards and shipping methods may vary depending on the destination country.
Orders shipped outside the European Union may be subject to customs procedures, import taxes, tariffs, fees, or other charges established by the destination country. Unless expressly stated otherwise, such charges will be the responsibility of the recipient when legally applicable to them.
The buyer is responsible for providing a correct delivery address and the information necessary to complete the shipment. Meals4hope will not be responsible for delays resulting from customs procedures or import restrictions beyond its control.
SECTION 28 — FORCE MAJEURE
We will not be responsible for delays or failures caused by circumstances reasonably beyond our control, including natural disasters, health emergencies, wars or conflicts, strikes, transport disruptions, serious supply problems, government restrictions, disruptions to essential services, or failures of technology or logistics providers.
This provision does not limit the rights that applicable law grants to the consumer as a result of a delay or breach.

NOTICE PRIOR TO PURCHASE
Each personalized print and postcard is created specifically on demand for each order. Therefore, returns due to change of mind are not available. If the order arrives defective, damaged, or does not correspond to what was requested, your legal rights remain protected.
